Dear Kelly,

I wish there was an easy answer. If you are embroiled in a custody case, you will find yourself cast in an unfair and unfortunate light.

Police are VERY skeptical on matters where domestics are involved. Your lawyer probably thinks it is a desperate attempt on your part and they don't want any part of it in the courtroom. Ironically, this is where it needs to be for the sake of your child.

Another person responded that you need to contact Children's Protective Services. They are absolutely right! It is important that preceding your argument with CPS, that you establish credibility.

First and foremost, you need to tell CPS that you can appreciate how this is about to sound.

Next, share that this abhorrent behavior by your estranged husband did not manifest itself prior to the Complaint for Divorce. Had your husband done this before, you most certainly would have included this in your filing, right?

Finally, tell CPS that you want your child protected and you expect an immediate intervention. Again, reiterate how this must sound to the skeptical ear.

If your husband used a computer in the home to view this porn with your five year old, you have the proof you need that at least porn was viewed. A skilled child psychologist can interview your child and make a credible determination if he was a party to the viewing.

In closing, you will be tempted to clue the father in on "your game plan" when he pushes your buttons. It is CRITICAL that you keep this to yourself and execute the proper steps to protect your child -- and get this man some help (after all, he will continue to be the father's child)

Good luck to you
Stay calm
Stay focused
YOU CAN DO THIS!
References :
Two decades on charitable boards

In PA, showing porn to a child is a crime. If you did indeed catch you're husband in the act then that's "proof" and you should contact the police. Let them decide if there's enough evidence to conduct a criminal investigation. They will probably have a specialist speak with your child. More than likely your lawyer is a civil attorney and not well versed in criminal law. I wouldn't recommend getting advice regarding criminal matters from a civil attorney. Leave that to the police and DA's office.
References :
that is actually called "corrupting the morals of a child" you do have to make a report to the police then press charges. Then---you'll have to have something corroborating with what you're saying...for instance your child needs to admit this to a DR. therapist, teacher or someone else credible. then---your child's father must be tried in court. I'd watch for this guy. if this is what he's showing a five year old....what happens when the kid is eight?
edit: you should have your child's pediatrician aware before you even make the report. tell him that you are very concerned and that you don't know what to do. he may ask your child himself but he WILL put your concerns in the child's file. or you could take your child to see a therapist. therapist records are excellent proof. but you should be very discreet and not let his father know that you are talking to these professionals...make a paper trail. also document the times that you've seen this happen.
References :
It appears you are going through an unpleasant divorce with child custody issues. Porn is sometimes difficult to define. By "sexually abused" do you think his father is actually using your son for sexual acts? If so, contact the police and Child Protective Services immediately!!
