DHS CPS took my neice and nephew. We need help.?
Recently my six year old neice was found outside alone at midnight. When the police picked her up (out of fear of being in trouble, we’re sure) she told them her dad dropped her off. This allegation has since been dropped because we pulled survelance videos that showed her walking, however she had bruises on her when they picked her up. Some were new (we speculated that they came from visiting the fair and riding a ride with her grandparents) as well as old ones on her legs. When asked, she told the police and CPS that she hit her head/ ear on a ride at the fair and when asked about the bruises on her legs she said some were from falling off her bike, others she wasn’t sure. My 11 year old nephew was also interviewed. He told the social worker that no, his parents don’t hit them, if they don’t listen to the rules they are reminded again, no his parents don’t fight, that his sister falls alot, bumps into furniture, he also told them about two occasions where she fell off his bed and hit her head. He also told them that she recently had her training wheels taken off her bike and was learning to ride without them. The night/morning that my neice was picked up, she was taken to the hospital and checked over and placed in a foster home for the night. The next morning, Saturday, the social worker spoke with both parents, and my nephew and convinced my brother and his wife to sign consent for voluntary foster care because it was a holiday weekend placing my neice in a foster home and my nephew with my mother. They have not been allowed to see either children and it has been a week and a half. The social worker has told my brother she believes he has been beating my neice for "a long period of time" reguardless of the fact that EVERYONE they have spoken to, including my neice says that they don’t even spank. There have been NO court hearings AT ALL, not even to have a judge approve placement of the children, and now my brother has been informed that they intend to have my neice examined by a doctor for sexual abuse, which can be a tramatic experience for a six year old girl, not to mention that there are NO accusations of sexual abuse or signs of sexual abuse!! My brother completed paperwork to get a court appointed attorney and they told him that he can’t have one because no charges have been filed, but in the mean time, he is clueless as to what his options are except for what we have found on the internet. We did learn he can retract their voluntary placement at any time and then DHS or CPS or whatever will have to get a court order to place the children, but DHS has threatened that if he does this, they will take my nephew from my mother and place him in fostercare too. We feel like it is an attempt to scare him into not doing this because they have not evidence and won’t find any because he doesn’t hit his children. Now we have also learned that they intend to "interview my niece. We are concerned, because of horror stories we have found on the net that they will lead her to say things that are not true!! What can we do? We need help!
